Terms and Conditions
By opting to be part of our events, you are accepting that these terms form an agreement between yourself and Phikology Events. You also certify that you are authorised to make decisions for the brand you apply for.
a) 3 business days before the market opens for the first day of the weekend (26th for monthly bookings): 100% refund.
b) 1 – 3 days before the market opens for the first day of the weekend (26th for monthly bookings): 50% refund.
c) On or after the market opens for the weekend (26th for monthly bookings): no refunds.
a) The Mall has final approval of vendors.
b) For the monthly booking option, your booking is month to month; stall bookings renew for the new month upon receipt of payment on the 26th of the preceding month. For Single Weekend bookings, your stall will only be considered secured once payment is received. IMPORTANT – unpaid stalls will be re-allocated to vendors on the waiting list.
c) Phikology Events reserves the right to terminate occupation should you fail to adhere to any of these terms, Phikology events will give 7 days’ notice.
d) For the monthly bookings, payments are due by the 26th of the month preceding occupation for monthly bookings. For Single Weekend bookings, payment is due on the last business day before the weekend the vendor books for.
e) Phikology Events reserves the right to review the stall fees at its discretion, vendors will be given notice at least a month before.
f) All vendors can start setting up by 08:00 am and must be fully set up by 09:00 am on the day of trade. If a vendor has not arrived and set up by 09:15 am, the stall will be allocated to a standby vendor and there will be no refunds, the loss will be borne by the vendor for the day. NO EXCEPTIONS.
g) If you are unable to attend on a particular day, we expect to be made aware that you will not be coming to the market the day before.
h) All vendors are required to stay at the Weekend Market, Saturday and Sunday, 09:00 am – 15:00 pm. If you need to leave early, you are required to get written authorisation from the Phikology Events team. No re-entry to trade will be accepted if a vendor has been authorised by Phikology Events to leave early. NO EXCEPTIONS.
i) No vendor can start packing up before 15:00 pm on trading day. NO EXCEPTIONS.
j) You must bring your receipt with you when you check in on the day of the event. You will receive more information via email outlining setup prior to the event. Follow our Facebook page for updates – www.facebook.com/phikology.
k) No spaces will be available to rent on the day of the event. Individuals can team up to rent a space, as long as the items remain in the space. Subletting, loaning, renting, or selling of your booth space to someone else is strictly prohibited. All rights to the booth space belong to Phikology Events. Booths can be reassigned, when necessary, for the good of the Market.
l) No credits will be issued for days of non-trade. If any stallholder is unable to trade on any certain day/s you will still be held liable to pay your stall fees for the said day/s.
3. WHAT CANNOT BE SOLD
a) Tobacco, combustibles, alcohol, knives, swords, or weapons of any kind. No fuel-based items, such as vehicles, lawnmowers, etc., may be sold inside. Also no provocative or suggestive items. No food and beverages allowed unless contracted to do so.
a) By opting to be part of our events, you are accepting that these terms form an agreement between yourself and Phikology Events. This agreement shall not constitute or be considered a partnership, employer-employee relationship, joint venture or agency between Phikology Events and the Exhibitor. The Exhibitor shall indemnify, defend, and hold harmless Phikology Events, Venue, their parent corporations and affiliates and their respective officers, directors, employees and representatives, and the successors and assigns of any of them, from and against, and reimburse them for, all claims, damages, costs and expenses, including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses, arising out of or resulting from
(i) any breach of any representation, warranty, covenant, obligation or other agreement contained in this Agreement;
(ii) out of any failure of Exhibitor to comply with any applicable laws, statutes, ordinances or regulations;
(iii) any act or omission or negligence of Exhibitor or its employees, agents, contractors or invitees;
(iv) any claim for personal injury or property damage or otherwise brought on behalf of any third party person, firm or corporation against Phikology Events and/or Venue as a result of or in connection with Exhibitor’s Booth which claim does not result from the active negligence of Phikology Events or Venue;
(v) any announcements, advertisements or other commercial copy produced, provided or approved by Sponsor for broadcast on a station owned by Phikology Events or its affiliates, including proceedings or litigation alleging infringement, unlawful use or violations of copyright; and/or
(vi) any defect, alleged or real, in any product of Sponsor’s sold or provided as samples to third parties by Sponsor or by Phikology Events as part of such party’s responsibilities under this Agreement. The foregoing indemnities shall survive the termination of this Agreement.
a) No demonstrations or solicitations shall be permitted outside of Exhibitor’s Booth, and no signs or placards may be displayed on persons or otherwise outside exhibit spaces without the written consent of Phikology Events.
a) Phikology Events, the Venue or any officer, employee or staff member thereof assumes no responsibility for the safety of the property or Exhibitor, their agents, or employees, from theft, damage by fire, accident, or any other cause. Exhibitor is welcome to insure their property and provide proof of insurance to Phikology Events.
a) Exhibitor assumes all responsibility for compliance with all pertinent ordinances, regulations and codes of duly authorized legal entities and governing bodies concerning rules and regulations and the display rules and regulations issued by Phikology Events and/or Venue.
8. CONDUCIVE ENVIRONMENT
a) We strongly believe in building a community and environment for all our vendors to thrive and make a success of their booking. For this reason; sabotaging, copying of each other’s offerings, and malicious pricing strategies that impact your fellow vendors are strictly prohibited. Engaging in such practices detracts from the overall good of the Market and may attract penalties which could lead to the infringing vendor being deemed to be in poor standing.
